Equal share of the co-wives (القَسْمُ بين الزَّوْجاتِ)

أصول الفقه

المعنى الاصطلاحي :

Dividing the man's time between his wives if he has two or more wives.

الشرح المختصر :

"Qasm bayn az-zawjāt" (equal share of the co-wives) means that a husband gives each of his wives an equal share of his time (if he is married to more than one wife). The wife's share of time means the time her husband spends with her alone or sleeps at her house, even if it is during the daytime depending on the nature of his work and free time. If the husband spends a night with one wife, then it is obligatory on him to spend a night with each of his other wives as well. A "nāshiz" wife (disobedient and rebellious against her husband) is not entitled to an equal share of his time, and the same applies for the wife who is in her post-divorce waiting period after a revocable divorce. "Nushūz" is rebellion of a wife against her husband concerning her obligatory duties.
