الشرح المختصر :
"Fisq" (disobedience) is violating the Islamic Shariah by abandoning its commandments or committing its prohibitions. Therefore, it may take the form of neglecting the obligations or committing the prohibitions. "Fisq" is divided into: major disobedience and minor disobedience. Whoever falls into "fisq" should be punished according to the type of crime he committed. If the crime requires a corporal punishment or retaliation, then he should receive the punishment he deserves. However, if it does not require a corporal punishment or retaliation, then the judge should give him a discretionary punishment that would deter him from committing sins.
